Pennsylvania boy awarded $4M cerebral palsy verdict

April 3rd, 2006

A Pennsylvania boy and his family have been awarded a $4 million medical malpractice lawsuit against his doctor and the hospital where
he was born. Jurors ruled that Drs. Roy Pazmino and Peter Matgouranis,
and Tyrone Hospital were liable for birth injuries that occurred during
the delivery of Jacob Mayhue in 1995. Because of his injuries, Jacob
has developed cerebral palsy.

According to court documents from the Mayhue family’s cerebral palsy attorney, doctors used forceps twice on the baby during delivery before performing a successful Caesarean section. However, the improper use of forceps cut off the blood supply to his brain. As a result, Jacob now suffers from cerebral palsy symptoms that include motor weakness, poor coordination and severe cognitive deficit.

Cerebral palsy affects about one in every 2,000 babies. While birth injury is the most common cause of cerebral palsy, other birth complications, blood clots, infection and meningitis are also known to cause the disease. Cerebral palsy symptoms can often affect a child’s ability to function in society, sometimes requiring a lifetime of assisted care and medical treatment.
